AI Transparency Notice

    The short version: HypeKyt makes your promo assets using an AI image model.
    Every image and video you export is tagged in its file metadata as AI-generated, so platforms
    can detect and label it. When you post an asset publicly, you should say it was made with AI —
    the caption we generate for you already does.
  

Why this page exists

The EU Artificial Intelligence Act (Regulation (EU) 2024/1689) applies its transparency rules — Article 50 — from 2 August 2026. Those rules cover exactly what HypeKyt does: generating synthetic images and video. This notice sets out how we comply and what that means for you.

1. You are using an AI system

HypeKyt is an AI system. When you upload artwork and hit Generate, your image is sent to a third-party generative image model (Google Gemini), which produces a new, synthetic image based on your input and the style you picked. Nothing you get back from HypeKyt is a photograph or a human-made illustration. Text suggestions and captions in the app are also model-generated.

2. Every asset is marked as AI-generated

Article 50(2) requires providers of generative AI systems to mark outputs in a machine-readable format so they are detectable as artificially generated. We do this by embedding standard provenance metadata directly in the file, at export time, on the device — the mark is written before the file ever reaches your disk.

Images (PNG / JPEG)	An XMP packet carrying the IPTC field `DigitalSourceType = trainedAlgorithmicMedia`, plus `CreatorTool`, a plain-language description, and a `hypekyt:AiGenerated` flag.
Videos (MP4)	Container metadata (`comment`, `description`, `encoder`, `digital_source_type`) carrying the same disclosure.

trainedAlgorithmicMedia is the IPTC NewsCodes term the industry has standardised on. It's the same signal read by Instagram, Facebook, TikTok, YouTube, LinkedIn and the C2PA / Content Credentials ecosystem — which is why an asset you export from HypeKyt will usually be labelled "AI info" or "Made with AI" automatically when you upload it.

An honest limitation: embedded metadata is a marking, not a watermark. Some platforms and editing tools strip metadata when a file is re-uploaded, re-encoded or screenshotted. That is why we also put the disclosure in the caption we generate, and why the responsibility in section 3 sits with you. 3. What you need to do when you publish

Under Article 50(4), the person who publishes AI-generated or AI-manipulated content is a "deployer" and carries their own disclosure duty. In practice:

Say it's AI when you post. The promo caption HypeKyt copies for you already ends with an AI disclosure — please leave it in. If you write your own caption, add something equivalent.
Use the platform's own label. Instagram, TikTok and YouTube all have an "AI-generated content" toggle. Turn it on.
Don't strip the metadata. If you edit an export in another tool, check that the provenance metadata survives, or re-add the disclosure yourself.
Be especially careful with real people. An asset that depicts a real, identifiable artist doing or saying something they didn't may be a "deep fake" under the Act, which carries a stricter disclosure duty — and it also breaches our Terms.

4. What HypeKyt does not do

We do not run emotion recognition or biometric categorisation on you or on any uploaded image.
We do not use your uploads or generated outputs to train AI models.
We do not produce AI-generated text about matters of public interest.
We do not operate any AI system listed as high-risk in Annex III of the AI Act.

5. Human oversight and your rights

Every generation is initiated by you and reviewed by you before it goes anywhere. Nothing is published automatically. You can regenerate, discard, or delete any asset from your gallery at any time, and you can delete your account and all associated assets from your profile page.
